This Privacy Policy explains how Myha LLC ("Myhá," "we," "us," or "our") collects, uses, stores, and protects personal information from Members and visitors in connection with the Myhá wellness platform available at myha.nyc (the "Service"). By using the Service, you consent to the practices described in this Policy.

1. Information We Collect

1.1 Information You Provide

During the onboarding intake process and in the course of your membership, we collect:

  • Full name and contact information (email address, phone number)
  • Schedule preferences and availability
  • Wellness goals and intentions
  • Physical limitations, injuries, or conditions you voluntarily disclose
  • Lifestyle preferences relevant to wellness planning
  • Communications and feedback you send to Myhá

1.2 Information Collected Automatically

When you use the platform, we may automatically collect certain technical information, including your IP address, browser type, device information, and pages visited, for the purpose of operating and improving the platform.

1.3 Payment Information

All payment processing is handled exclusively by Stripe, a third-party payment processor. Myhá does not collect, store, or process payment card data directly. Your payment information is governed by Stripe's Privacy Policy and Terms of Service.

2. How We Use Your Information

We use your personal information exclusively for the following purposes:

  • Designing and personalizing your individual weekly wellness routine
  • Scheduling and coordinating sessions at third-party venues on your behalf
  • Communicating with you regarding your wellness plan, session confirmations, reminders, and updates
  • Operating, maintaining, and improving the Myhá platform
  • Complying with applicable legal obligations

We do not use your personal information for advertising, marketing to third parties, or any purpose unrelated to the direct delivery of the Myhá service.

3. How We Share Your Information

Myhá does not sell, license, rent, or transfer your personal data to third parties for marketing or commercial purposes.

We share your information only in the following limited circumstances:

3.1 Third-Party Venues

When coordinating a booking on your behalf, we may share the minimum information necessary to facilitate that booking — typically your name and contact information — with the relevant third-party venue. We do not share your health information, wellness goals, or other sensitive intake data with any venue.

3.2 Service Providers

We may share information with trusted service providers who assist us in operating the platform (such as Stripe for payment processing and hosting providers). These providers are bound by confidentiality obligations and may only use your data to perform services on our behalf.

3.3 Legal Requirements

We may disclose your information if required to do so by law or in response to valid legal process, or to protect the rights, property, or safety of Myhá, our Members, or the public.

4. Data Retention

We retain your personal information for as long as your membership is active and for twelve (12) months following cancellation or termination of your membership, unless a longer retention period is required by applicable law or necessary for the resolution of disputes or enforcement of our agreements.

Health and lifestyle information collected during the intake process will be treated with heightened care and deleted promptly once it is no longer necessary for the delivery of your wellness routine. Upon your request for deletion (see Section 6), we will delete or anonymize your personal data within thirty (30) days, except where retention is required by applicable law.

5. Data Security and New York SHIELD Act Compliance

Myha implements reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, disclosure, alteration, or destruction, consistent with the requirements of the New York Stop Hacks and Improve Electronic Data Security (SHIELD) Act.

In the event of a security breach that compromises the security, confidentiality, or integrity of your personal information, Myha will notify affected Members in accordance with applicable New York law. Notification will be made in the most expedient time and manner possible and without unreasonable delay.

No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. However, we are committed to promptly addressing any suspected or confirmed security incidents.

5a. Sensitive Health Information

Myha recognizes that information you share during the intake process — including physical limitations, injuries, health conditions, and wellness goals — is sensitive in nature. While Myha is not a covered entity under HIPAA, we treat this information with heightened confidentiality standards.

Your health and lifestyle information is used solely to design and personalize your wellness routine. It is never shared with third-party venues, other members, or any external party except as expressly described in this Policy. Access to this information within Myha is limited to personnel directly involved in designing your wellness plan.

6. Your Rights and Choices

You have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate or incomplete data
  • Request deletion of your personal data at any time by contacting us directly
  • Withdraw consent to certain uses of your data (which may affect your ability to use the Service)

To exercise any of these rights, please contact Myhá directly. We will respond to your request within a reasonable timeframe.

7. Cookies and Tracking

The Myhá platform may use cookies and similar tracking technologies to operate and improve the platform experience. You may configure your browser to decline cookies, though doing so may affect certain platform functionality.

8. Children's Privacy

The Service is intended for adults aged 18 and older. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have inadvertently collected information from a minor, we will take steps to delete it promptly.

9. Third-Party Links and Services

The platform may contain links to third-party websites or services, including third-party venue websites. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you access.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email or through the platform. Your continued use of the Service after the effective date of the revised Policy constitutes your acceptance of the changes.
